Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and MY NOVELTY LABS LLC, which operates MyNovelty (“MyNovelty,” “we,” “us,” or “our”). They govern your access to mynovelty.io, our applications, the MyNovelty UCI bridge, cloud engines, and related services (collectively, the “Service”).

By creating an account, purchasing a plan or token pack, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

The Service

MyNovelty provides browser and cloud chess-engine analysis, repertoire tools, public game and broadcast data, file synchronization, usage-based compute, and related features. Features, engine versions, capacity, and plan limits may change over time. Some features may be identified as beta, preview, experimental, or locally processed and may be less reliable than generally available features.

Chess-engine output is probabilistic and depends on the position, settings, hardware, time, and engine version. We do not promise that analysis is accurate, complete, unique, or suitable for any particular decision.

Accounts and Security

• Provide accurate account information and keep it reasonably current.
• Keep passwords, API keys, bridge credentials, two-factor codes, and recovery codes confidential.
• Do not share an account in a way that bypasses plan limits or exposes another person's data.
• Notify support@mynovelty.io promptly if you suspect unauthorized access.

You are responsible for activity under your account until you notify us of unauthorized use. We may require email verification, reauthentication, or additional security checks before sensitive actions.

Your Content

You retain ownership of PGNs, repertoire files, annotations, feedback, and other content you submit (“Your Content”). You grant MyNovelty a worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, format, and display Your Content only as needed to provide, secure, support, and improve the Service and comply with law. This license ends when the content is deleted from our active systems, except for retained backups, legal records, or de-identified data.

You represent that you have the rights needed to submit Your Content and that our processing of it as described here will not violate another person's rights or applicable law. Do not upload confidential or sensitive personal information that is unnecessary for chess analysis.

Public Chess Data

The Service may index, organize, and display chess games, player names, ratings, events, broadcasts, and related facts obtained from public or licensed sources. Public chess records are not Your Content merely because they refer to you. To report an inaccurate record or a rights concern, contact support with the relevant URL and details.

Acceptable Use

You may not use the Service to:

• Break the law, infringe intellectual-property or privacy rights, or encourage another person to do so.
• Use engine assistance in a live game, exam, event, or competition where assistance is prohibited, or help another person cheat.
• Probe, scan, attack, overload, disrupt, or bypass security, access controls, rate limits, plan limits, token accounting, or technical restrictions.
• Access another person's account or data, share credentials, or automate account creation without authorization.
• Scrape or bulk extract the Service or its databases except through an expressly authorized interface and within published limits.
• Reverse engineer proprietary portions of the Service except where the restriction is prohibited by law or an applicable open-source license.
• Resell, sublicense, or provide the Service to third parties as a commercial service unless we agree in writing.
• Upload malware, abusive content, or content that creates a material security or legal risk.

We may investigate suspected misuse and restrict or suspend access when reasonably necessary to protect users, providers, the Service, or third parties.

Plans, Tokens, and Payment

Prices and taxes

Unless a checkout page expressly says otherwise, prices are in U.S. dollars (USD). You authorize Stripe to charge the payment method you provide for purchases, applicable taxes, and recurring charges you approve. You are responsible for taxes that are not collected by us.

Subscriptions and automatic renewal

A paid subscription is billed in advance for the term shown at checkout, such as monthly, quarterly, six-month, or annual. It automatically renews for successive terms of the same length at the then-current disclosed price unless you cancel before the renewal date. Before you subscribe, checkout shows the price, billing frequency, included token bucket, and any trial or promotional terms. By completing checkout, you expressly authorize the initial and recurring charges described there.

Included subscription tokens are available for the applicable billing term and do not roll into a later subscription term. If an account is moved to a different plan, features, token allowances, and price may change as disclosed during the change.

Token packs

Token packs are one-time purchases of cloud-compute credits. Purchased tokens do not expire while your account remains open, but they are non-transferable, have no cash value, and are consumed as cloud compute is used. Displayed time estimates are approximate because engines and compute tiers consume tokens at different rates.

Optional automatic top-ups

If you enable automatic top-up, you authorize Stripe to save your selected payment method and charge the selected token pack off-session when your balance falls below the threshold shown in your settings. The setting remains active until you turn it off, a payment fails, or we disable it for security or operational reasons. You can change or turn off automatic top-up from your account before the next charge.

Trials and promotions

Additional terms shown with a trial, coupon, or promotion are part of these Terms. A no-card trial does not create a charge. If an offer will convert to a paid subscription, the price, conversion date, renewal terms, and cancellation method will be disclosed before enrollment. Unless the offer says otherwise, one trial or promotion is available per person and may not be combined or transferred.

Cancellation

You may cancel a subscription online at any time through Settings or the Stripe billing portal linked from your account. Cancellation stops the next automatic renewal; paid access ordinarily continues through the end of the current billing term. Turning off automatic top-up stops future top-up attempts but does not reverse a completed purchase.

Deleting an account is permanent and makes remaining tokens and account content unavailable. If you have an active subscription, cancel it from the billing controls before deleting your account to ensure future renewals stop. If you cannot access the online controls, contact support@mynovelty.io.

Refund Policy

Except where required by law or expressly stated at purchase, payments are non-refundable and we do not provide prorated refunds or credits for a partially used billing term. Consumed tokens cannot be returned. We will correct duplicate or erroneous charges, and we may issue a refund or service credit when a purchase cannot be delivered because of a material failure of the Service. Contact support@mynovelty.io promptly with the account email, charge date, and reason for the request. This policy does not limit non-waivable cancellation, withdrawal, or refund rights under applicable law.

Price and Term Changes

We may change prices or subscription terms prospectively. We will provide the notice required by law before a change affects an existing subscription and explain how to cancel. A price change will not alter a billing term that you have already paid for.

Third-Party Services

The Service interoperates with payment, sign-in, chess-data, cloud, desktop chess, and other third-party services. Your use of a third-party service is governed by its own terms. MyNovelty is not sponsored or endorsed by Chess.com, Lichess, ChessBase, Fritz, Arena, Stockfish, Leela Chess Zero, or their respective owners unless expressly stated.

Our Rights and Open Source

MyNovelty and its licensors retain all rights in the Service other than Your Content. These Terms do not grant you a right to use our names, logos, domains, or other brand features. You may provide feedback, and you grant us a perpetual, worldwide, royalty-free right to use that feedback without restriction or compensation.

Parts of the Service include open-source software and third-party data governed by their own licenses. Those licenses control if they conflict with these Terms. See our Open-Source Notices for key attributions and source links.

Suspension and Termination

You may stop using the Service at any time. We may limit, suspend, or terminate access if you materially breach these Terms, create legal or security risk, fail to pay, abuse providers or other users, or if continuing the Service is no longer commercially or technically practical. When reasonable, we will give notice and an opportunity to cure before termination. We may act immediately for fraud, security threats, unlawful conduct, or serious abuse.

Sections that by their nature should survive termination—including payment obligations, ownership, disclaimers, limits of liability, and dispute terms—will survive.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” MyNovelty disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, perpetual availability of any engine or provider, preservation of every file, or any rating, tournament, financial, or competitive result. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, MyNovelty and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or opportunities, arising from the Service or these Terms. Our total liability for all claims arising from the Service or these Terms will not exceed the greater of US $100 or the amount you paid to MyNovelty during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

Indemnity

To the extent permitted by law, you will indemnify and hold MyNovelty harmless from third-party claims, damages, and reasonable costs arising from Your Content, your unlawful or abusive use of the Service, or your material breach of these Terms. This obligation does not apply to the extent a claim results from MyNovelty's own unlawful conduct.

Disputes and Applicable Law

Before filing a formal claim, you and MyNovelty agree to try in good faith to resolve the dispute by written notice and 30 days of informal discussion. Send notices to legal@mynovelty.io. These Terms are governed by applicable law, without limiting mandatory consumer protections available where you live. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using a small-claims process where eligible.

Changes to the Service or Terms

We may modify or discontinue features and may update these Terms. The updated Terms will be posted here with a new “Last updated” date. If a change materially affects your rights or an existing paid subscription, we will provide additional notice as required by law. By continuing to use the Service after updated Terms take effect, you agree to them.

General

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. These Terms, the Privacy Policy, and purchase-specific terms are the entire agreement about the Service.
